The following information provides you with an overview of the processing of your personal data by Cumdente GmbH and your rights in relation to data protection. Personal data is all data that can be personally related to natural persons, such as name, address, e-mail address, etc. With regard to the terms used, such as "processing" or "controller", we refer to the legal definitions in Art. 4 of the General Data Protection Regulation (GDPR). Cumdente GmbH's privacy policy must be read in conjunction with other legal notices and terms of use that may be provided on other pages of our website or when initiating a contract. Which data is otherwise processed and used in detail depends largely on the services requested or agreed in each case. Please note the respective data protection declarations, which we may send you separately as part of the contract initiation process.

2. Information about the categories and sources of personal data that we process
If you use our www.cumdente.com, www.apacare.com for information purposes only, i.e. if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server (server log files). If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you, to ensure its stability and security and to fulfil other administrative tasks (legal basis is Art. 6 para. 1 sentence 1 lit. f GDPR). The following information is collected without any action on your part and temporarily stored in a log file IP address, date and time of the request, content of the request (name and URL of the retrieved file), access status/HTTP status code, website from which the request comes (referrer URL), browser used and, if applicable, the operating system of your computer, the name of your access provider and the amount of data transferred in each case. We also use cookies and analysis services when you visit our website. You can find more detailed explanations on this in section 10ff. of this privacy policy.
When you contact us by e-mail, fax, post or telephone, the data you provide will be stored by us in order to answer your questions. It is necessary to provide a valid e-mail address, fax or telephone number or address so that we know who sent the enquiry and can answer it. Data processing for the purpose of establishing contact and initiating business with us is always based on your voluntary consent (Art. 6 para. 1 lit. a GDPR). We delete the data collected in this context after storage is no longer necessary or restrict processing if there are statutory retention obligations.
We also process personal data that we receive from our customers as part of our business relationship. In addition, we process - to the extent necessary for the provision of our services - personal data that we have legitimately received from other third parties (e.g. for the execution of orders, for the fulfilment of contracts or on the basis of consent given by you). Furthermore, we process personal data that we have legitimately obtained from publicly accessible sources (e.g. commercial and association registers, press, media, internet, debtor directories) and are authorised to process.
Relevant personal data in the prospective customer process, registration with a user account or when concluding a contract may be: practice/name, address/other contact details (telephone, e-mail address), gender, date of birth, payment information.
As part of the business initiation phase and during the business relationship, in particular through personal, telephone, electronic or written contacts initiated by you or by us, further personal data is generated, e.g. information about the contact channel, date, occasion and result; (electronic) copies of correspondence and information about participation in direct marketing measures.
3. Purpose of data processing and indication of the legal basis
We process the aforementioned personal data in accordance with the GDPR and the Federal Data Protection Act (BDSG):
a. For the fulfilment of contractual obligations (Article 6(1)(b) GDPR) The processing of personal data takes place for the provision and sale of products or other contractual services to our customers or for the implementation of pre-contractual measures that take place at your request. The purposes of data processing are primarily based on the specific service and may include correspondence, order processing, advice/training and the provision of products and services. Further details on the purpose of data processing can be found in the respective contract documents.
b. As part of the balancing of interests (Article 6(1)(f) GDPR) If necessary, we process your data beyond the actual fulfilment of the contract to protect our legitimate interests or those of third parties, unless the interests or fundamental rights and freedoms of the data subject, which require the protection of personal data, prevail. Examples:
- Consultation of and data exchange with credit agencies to determine creditworthiness and default risks
- Examination and optimisation of procedures for needs analysis and direct customer contact
- Advertising or market and opinion research, unless you have objected to the use of your data
- Assertion of legal claims and defence in legal disputes
- Ensuring the IT security and IT operations of Cumdente GmbH
- Prevention of criminal offences
- Measures for building and system security (e.g. access controls)
- Measures to safeguard domiciliary rights
- Measures for business management and further development of services and products
- Risk management
c. On the basis of your consent (Article 6(1)(a) GDPR) If you have given us your consent to process personal data for specific purposes, the lawfulness of this processing is based on your consent. Any consent given can be revoked at any time. This also applies to the revocation of declarations of consent that were given to us before the EU General Data Protection Regulation came into force, i.e. before 25 May 2018. Please note that the revocation is only effective for the future. Processing that took place before the revocation is not affected.
d. Due to legal requirements (Article 6(1)(c) GDPR) or in the public interest (Article 6(1)(e) GDPR) As a company, we are also subject to various legal obligations, i.e. statutory requirements (e.g. German Commercial Code, tax laws). The purposes of processing include the fulfilment of tax regulations, as well as the assessment and management of risks for our company.
4. Recipient of the data
Within Cumdente GmbH, those departments that need your data to fulfil our contractual and legal obligations will have access to it. Service providers and vicarious agents employed by us may also receive data for these purposes if they comply with our written instructions under data protection law. These are essentially companies from the categories listed below.
With regard to the transfer of data to third parties, it should always be noted that we may only pass on information about you if (i) legal provisions permit this (e.g. if a transfer of the data to third parties pursuant to Art. 6 para. 1 lit. b. GDPR to fulfil the contract or to protect our legitimate interests pursuant to Art. 6 para. 1 lit. f, e.g. when using agents, web hosts, etc.), (ii) there is a legal obligation, (iii) you have consented, (iv) and/or processors commissioned by us guarantee compliance with the requirements of the GDPR and the Federal Data Protection Act (Art. 28 GDPR, § 62 BDSG).
Under these conditions, recipients of personal data may be, for example
- Public bodies and institutions in the event of a legal or official obligation.
- Other organisations and processors to whom we transfer personal data in order to carry out the business relationship with you. In detail: Support/maintenance of EDP/IT applications, archiving, call centre services, controlling, data destruction, purchasing/procurement, hosting providers, customer administration, letter shops, marketing, media technology, expense accounting, tax consultancy services, telephony, website management, webshop management, logistics, payment transactions. Other data recipients may be those bodies for which you have given your consent to data transfer.
5. Data transfer to a third country or to an international organisation
Data is only transferred to countries outside the EU/EEA (so-called third countries) or to international organisations if this is necessary to execute your orders, is required by law (e.g. reporting obligations under tax law), if you have given us your consent or as part of commissioned data processing. If service providers are used in a third country, they are obliged - in addition to written instructions - to comply with the level of data protection in Europe by agreeing the EU standard contractual clauses. The current EU standard contractual clauses are available at www.eur-lex.europa.eu.
6. Duration of data storage
We process and store your personal data for as long as and to the extent necessary for the fulfilment of our contractual and legal obligations. It should be noted that our business relationship is generally based on long-term cooperation. If the data is no longer required for the fulfilment of contractual or legal obligations, it is regularly deleted unless its - temporary - further processing is required for the following purposes:
- Fulfilment of retention periods under commercial and tax law: In particular, the German Commercial Code and the German Fiscal Code should be mentioned. The retention and documentation periods specified there are two to ten years.
- Preservation of evidence within the framework of the statute of limitations. According to Sections 195 et seq. of the German Civil Code (BGB), these limitation periods can be up to 30 years, whereby the regular limitation period is three years.
7. Data protection rights of data subjects
Every data subject has the right of access under Article 15 GDPR, the right to rectification under Article 16 GDPR, the right to erasure under Article 17 GDPR, the right to restriction of processing under Article 18 GDPR, the right to object under Article 21 GDPR and the right to data portability under Article 20 GDPR. The restrictions under Sections 34 and 35 BDSG apply to the right of access and the right to erasure. There is also a right to lodge a complaint with a data protection supervisory authority (Article 77 GDPR in conjunction with Section 19 BDSG).
You can withdraw your consent to the processing of personal data at any time. This also applies to the revocation of declarations of consent given to us before the EU General Data Protection Regulation came into force, i.e. before 25 May 2018. Please note that the revocation is only effective for the future. Processing that took place before the cancellation is not affected. If you wish to make use of your right of cancellation, you can do so in any form, for example by sending an email to datenschutz@cumdente.de.
8. Obligation to provide data
As part of our business relationship, you must provide the personal data that is necessary for the establishment and execution of a business relationship and the fulfilment of the associated contractual obligations or that we are legally obliged to collect. Without this data, we will generally have to refuse to conclude the contract or execute the order or will no longer be able to fulfil an existing contract and may have to terminate it.
9. Existence of automated decision-making (including profiling)
In principle, we do not use fully automated decision-making in accordance with Article 22 GDPR to establish and conduct the business relationship. Should we use these procedures in individual cases, we will inform you of this separately if this is required by law.
We process your data partly automatically with the aim of evaluating certain personal aspects (profiling). We use profiling in the following cases, for example:
- In order to provide you with targeted information and advice on products, we may use analysis tools. These enable needs-based communication and advertising, including market and opinion research.
- As part of the assessment of your creditworthiness, we may use the scoring of credit agencies. This involves calculating the probability that a customer will fulfil their payment obligations in accordance with the contract. Scoring is based on mathematically and statistically recognised and proven procedures. The score values calculated by the credit agencies support us in our decision-making and are included in our company's ongoing risk management.
10. Cookies
We use cookies on our website. These are small files that your browser automatically creates and that are stored on your end device (laptop, tablet, smartphone, etc.) when you visit our website. Cookies do not cause any damage to your end device and do not contain any viruses, Trojans or other malware. Information is stored in the cookie that results in each case in connection with the specific end device used. However, this does not mean that we obtain direct knowledge of your identity. On the one hand, the use of cookies serves to make the use of our website more convenient for you. For example, we use session cookies to recognise that you have already visited individual pages of our website. These are automatically deleted after you leave our site.
In addition, we also use temporary cookies to optimise user-friendliness, which are stored on your end device for a specified period of time. If you visit our site again to use our services, it is automatically recognised that you have already visited us and which entries and settings you have made so that you do not have to enter them again.
On the other hand, we use cookies to statistically record the use of our website and to evaluate it for the purpose of optimising our offer for you. These cookies enable us to automatically recognise that you have already visited our website when you visit it again. These cookies are automatically deleted after a defined period of time. The data processed by cookies is required for the purposes mentioned to protect our legitimate interests and those of third parties in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR.
You can configure your browser settings according to your wishes and, for example, refuse to accept third-party cookies or all cookies. We would like to point out that in these cases you may not be able to use all the functions of this website.
11. Use of Google Analytics 4
Our websites use Google Analytics 4, a web analytics service provided by Google Inc ("Google"). Google Analytics uses cookies, text files that are stored on your computer and other end devices and that enable your use of the website to be analyzed. Google Analytics also uses artificial intelligence (AI) and machine learning to process data for data analysis. The information generated by the cookie about your use of our website is usually transmitted to a Google server in the USA, where it is stored and analyzed.
We would like to point out that on our website Google Analytics has been extended by the code "gat._anonymizeIp();" in order to ensure anonymised collection of IP addresses (so-called IP masking). At our request, your IP address is therefore only recorded by Google in abbreviated form, which ensures anonymisation and does not allow any conclusions to be drawn about your identity. Due to the activation of IP anonymisation, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there.
Google will use this information on behalf of our company to analyse your use of the website, to compile reports on website activity and to provide our company with other services relating to website activity and internet usage.
The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. The legal basis for our use is Art. 6 para. 1 lit. f GDPR.

You can also prevent Google Analytics from collecting your data by clicking on the following link. 12. Google Maps
We use the Google Maps service on our websites. This allows us to show you interactive maps directly on the website and enables you to use the map function conveniently. The legal basis for our use of the data generated in this way is Art. 6 para. 1 sentence 1 lit. f) GDPR.
By visiting the website, Google receives the information that you have accessed the corresponding subpage of our website. In addition, the data mentioned in section 2 (1) of this declaration will be transmitted. This occurs regardless of whether Google provides a user account through which you are logged in or whether no user account exists. If you are logged in to Google, your data will be assigned directly to your account. If you do not wish your data to be associated with your Google profile, you must first log out of your Google user account. Google stores your data as usage profiles and uses them for the purposes of advertising, market research and/or the customised design of its website. Such an analysis is carried out in particular (even for users who are not logged in) to provide customised advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles, whereby you must contact Google to exercise this right.

13. Google Analytics Remarketing
Our websites use the functions of Google Analytics Remarketing in conjunction with the cross-device functions of Google AdWords and Google DoubleClick. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
This function makes it possible to link the advertising target groups created with Google Analytics Remarketing with the cross-device functions of Google AdWords and Google DoubleClick. In this way, interest-based, personalised advertising messages that have been adapted to you depending on your previous usage and surfing behaviour on one end device (e.g. mobile phone) can also be displayed on another of your end devices (e.g. tablet or PC).
If you have given your consent, Google will link your web and app browsing history to your Google account for this purpose. In this way, the same personalised advertising messages can be displayed on every device on which you sign in with your Google account. To support this function, Google Analytics collects Google-authenticated user IDs that are temporarily linked to our Google Analytics data in order to define and create target groups for cross-device advertising.
You can permanently object to cross-device remarketing/targeting by deactivating personalised advertising in your Google account by following this link: https://www.google.com/settings/ads/onweb/.
The aggregation of the data collected in your Google Account is based solely on your consent, which you can give or withdraw from Google (Art. 6 para. 1 lit. a GDPR). For data collection processes that are not merged in your Google account (e.g. because you do not have a Google account or have objected to the merging), the collection of data is based on Art. 6 para. 1 lit. f GDPR.
The legitimate interest arises from the fact that Cumdente GmbH has an interest in the anonymised analysis of website visitors for advertising purposes. 14. Google AdWords and Google Conversion Tracking
This website uses Google AdWords. AdWords is an online advertising programme of Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States ("Google"). As part of Google AdWords, we use what is known as conversion tracking. When you click on an advert placed by Google, a cookie is set for conversion tracking. Cookies are small text files that the Internet browser stores on the user's computer.
These cookies lose their validity after 30 days and are not used to personally identify the user. If the user visits certain pages of this website and the cookie has not yet expired, Google and we can recognise that the user clicked on the ad and was redirected to this page. Each Google AdWords customer receives a different cookie. The cookies cannot be tracked via the websites of AdWords customers. The information collected using the conversion cookie is used to generate conversion statistics for AdWords customers who have opted for conversion tracking. Customers find out the total number of users who clicked on their advert and were redirected to a page with a conversion tracking tag.
However, they do not receive any information with which users can be personally identified.
The storage of "conversion cookies" is based on Art. 6 para. 1 lit. f GDPR. Cumdente GmbH has a legitimate interest in analysing user behaviour in order to optimise both its website and its advertising.
If you do not wish to participate in tracking, you can object to this use by easily deactivating the Google Conversion Tracking cookie via your Internet browser under user settings. You will then not be included in the conversion tracking statistics.

15. Google reCaptcha
The reCaptcha service from Google is used on our digital offerings to protect us from spam and misuse. This service is used to distinguish whether an entry has been made by a human or abusively by automated, machine processing.
To determine this, Google places a cookie in your browser when you use the reCaptcha service and collects and processes the following data:
- Referrer URL (address of the page on which the reCaptcha is used)
- Browser, browser size and resolution, browser plug-ins, date, language setting
- Mouse or touch events within the reCaptcha box
- Assignment to a Google account (if you are currently logged in to Google when using the reCaptcha service, this will be recognised and assigned)
Your input behaviour (e.g. answering the reCaptcha question, input speed in the form fields, order of selection of input fields by the user) is used to improve pattern recognition at Google.
Google also reads the cookies from other Google services such as Gmail, Search and Analytics. All of this data is sent to Google in encrypted form. Google's subsequent evaluation decides in which form the reCaptcha is displayed on the page - in the form of a checkbox or via text input. No personal data is read or saved from the input fields of the respective form. Further information on Google's data protection policy can be found at https://policies.google.com/privacy.
The legal basis for the use of reCaptcha is Art. 6 para. 1 sentence 1 lit. f) GDPR. Of course, you can object to the collection of data by Google's reCaptcha service on our websites with effect for the future. Unfortunately, you will then no longer be able to use all the functions on our digital offerings.
16. Google Web Fonts
Our pages use so-called web fonts provided by Google for the standardised display of fonts. When you access a page, your browser loads the required web fonts into your browser cache in order to display texts and fonts correctly.
For this purpose, the browser you are using must connect to Google's servers. This informs Google that our website has been accessed via your IP address. The use of Google Web Fonts is in the interest of a uniform and appealing presentation of our online offers. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.
If your browser does not support web fonts, a standard font will be used by your computer.

17. YouTube
Our websites use the provider YouTube LLC , 901 Cherry Avenue, San Bruno, CA 94066, USA, represented by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, for the integration of videos: Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. When you access a page with embedded videos, your IP address is sent to YouTube and cookies are stored on your computer. However, we have integrated our YouTube videos with the extended data protection mode (in this case, YouTube still contacts Google's Double Click service, but according to Google's privacy policy, personal data is not analysed). This means that YouTube no longer stores any information about visitors unless they watch the video. If you click on the video, your IP address is transmitted to YouTube and YouTube learns that you have watched the video. If you are logged in to YouTube, this information will also be assigned to your user account (you can prevent this by logging out of YouTube before watching the video). We have no knowledge of and no influence on the possible collection and use of your data by YouTube. There you can also find out more about your rights in this regard and the setting options for protecting your privacy.
Opt-out option: To prevent YouTube from collecting information about you during your visit to our website, you can log out of YouTube at the beginning of your visit to our website and delete any existing YouTube cookie from the browser you are using.
18. Social Media Plug-Ins
So-called "social media plug-ins" are technologies that enable you as a user to make certain content known to members of social networks via a direct connection. To enable you to do this, our websites have social media plug-in functions for the networks Xing, LinkedIn, Facebook, Twitter and Google+. The legal basis for our use of social media plug-ins is Art. 6 para. 1 sentence 1 lit. f GDPR.
To protect your privacy, we offer you these social plug-ins as a so-called two-click solution. This is a technical solution that basically prevents data (e.g. IP address) from being transmitted to the social networks Xing, LinkedIn, Facebook, Twitter and Google+ as soon as you open our website. This means that the social plug-in buttons of the aforementioned networks are deactivated by default. They are only activated when you click on the respective social media plug-in for the first time. The content of the plug-in is transmitted from the social networks to your browser, which integrates it into our website. By clicking on the respective social media plug-in a second time, you can use the functions such as "Recommend" in full.
This activation is stored in your browser for up to eight weeks. You can deactivate the function at any time by clicking on the individual buttons or by deleting the cookies in your browser.
If you are a member of Xing, LinkedIn, Facebook, Twitter and Google+ and do not want these social networks to collect data when you use our website, you must log out before visiting our company's website and before activating the social plug-in. You can also block social plug-ins with various add-ons for your browser.
Please note the following points for the respective plug-ins:

You can recognise the XING buttons by terms such as "XING" or a large green "X" on a white background. With the help of these buttons it is possible to share a post or page of this offer on XING or to participate in discussions of Cumdente GmbH or its digital offers on XING. When a user accesses a web page of this website and clicks on the XING button, the browser establishes a direct connection with the XING servers. The content of the XING button is transmitted by XING directly to the user's browser.
Our company has no influence on the scope of the data that XING collects with the help of this plug-in. Our company has no influence on the scope of the data that LinkedIn collects with the help of this plug-in. c. Facebook
You can recognise the Facebook buttons by the lettering "Facebook" or a stylised "thumbs up" or by a blue or white "small f" on a white or blue background.
Our company has no influence on the scope of the data that Facebook collects with the help of this button. However, we would like to inform you about this as far as possible:
By activating the plug-ins, Facebook receives the information that a user has accessed the corresponding page of the website. If the user is logged in to Facebook, Facebook can assign the visit to their Facebook account. If users interact with the plug-ins, for example by clicking the Like button or using the Share function, the corresponding information is transmitted directly from your browser to Facebook and stored there. If a user is not a member of Facebook, it is still possible for Facebook to find out their IP address and store it. According to Facebook, only an anonymised IP address is stored in Germany. You can recognise the Twitter buttons by terms such as "Twitter" or "Follow", combined with a stylised blue bird. With the help of these buttons, it is possible to share a post or page of this website on Twitter or to follow Cumdente GmbH or its digital offerings on Twitter. When a user accesses a web page on this website and activates the Twitter button, the browser establishes a direct connection with the Twitter servers. The content of the Twitter button is transmitted by Twitter directly to the user's browser.
